The Supreme Court held that the Delhi Development Authority's (DDA) recruitment rules for promotions must comply with Section 57 of the Delhi Development Act, 1957, which requires prior approval from the Central Government and laying of rules before Parliament. The Court found that the DDA's resolution to compare its recruitment rules with those of the Central Public Works Department was not sufficient to justify the denial of pay-scale upgradation to the appellant, a degree holder, compared to diploma holders. The Court overturned the High Court's dismissal of the appellant's writ petition, ruling that the DDA's actions were arbitrary and discriminatory.
