The Court emphasized that under Paragraph 228 of the Indian Railway Establishment Manual, no arrears are payable for periods where the employee did not perform duties of the higher post. The Court found the reliance on the precedent set in Harbans Singh v. State of Punjab (1995) appropriate, thus dismissing the appeal by the Union of India.
