Judgment text excerpt

The Supreme Court held that Isher Kaur, having received property under the will of Ralla Singh, only had a life estate and could not gift the property to the Gurdwara. The Court applied Section 14(2) of the Hindu Succession Act, establishing that the limitations imposed by the will were binding on Isher Kaur, and thus her estate could not be enlarged under Section 14(1). The Court reversed the High Court's decision, affirming the lower appellate court's ruling that the appellant was entitled to recover possession of the property after Isher Kaur's death.
