The Supreme Court held that the Interest on Delayed Payments to Small Scale and Ancillary Industrial Undertakings Act, 1993 (the 1993 Act) does not prevail over the Sick Industrial Companies (Special Provisions) Act, 1985 (the 1985 Act) as both operate in different fields. The Court ruled that the award made by the Industry Facilitation Council in favor of the Respondent was non-executable since it had been considered in the revised rehabilitation scheme sanctioned under the 1985 Act. Consequently, the High Court's dismissal of the Appellant's writ petition was upheld, affirming the non-execution of the award due to the Appellant's status as a sick company under the 1985 Act.
