The Supreme Court ruled that the proposed sale of Hotel Agra Ashok by the India Tourism Development Corporation (ITDC) was arbitrary and illegal, violating the principles of natural justice and the rights of the employees under Article 21 of the Constitution. The Court held that the service conditions of the employees must be preserved and that the Voluntary Retirement Scheme (VRS) should be uniformly applied to all employees, not just selectively. The Court issued directions to maintain the status quo regarding the service conditions of the employees pending the resolution of the case.
