The Supreme Court held that the circular dated 27.11.2001, which mandated that a new consumer must clear the outstanding dues of the previous consumer before receiving a fresh electric connection, was valid under Section 49 of the Electricity (Supply) Act, 1948. The Court ruled that the first respondent's Writ Petition was not maintainable as the matter was already before the Civil Court, and thus the appellant's refusal to provide a new connection was justified. The Court dismissed the Writ Petition, affirming the statutory authority of the appellant to impose such conditions.
