Judgment text excerpt
The Supreme Court addressed the validity of the tender process conducted by Assam Electronics Development Corporation Ltd. (AMTRON) under the Rajiv Gandhi Computer Literacy Programme. The Court held that the failure to disclose the evaluation criteria for technical and commercial bids violated principles of transparency and fairness in public procurement, as mandated by Article 14 of the Constitution. Consequently, the Court quashed the award of the contract to NIIT and directed AMTRON to reevaluate the bids in accordance with a fair and transparent process.
