The Supreme Court ruled that under the M.P. Krishi Upaj Mandi Adhiniyam, 1972, market fees can only be levied on agricultural produce brought into the market area for the purpose of sale or processing. The Court held that since the appellant, a paper manufacturing company, was using bamboo and wood as raw materials sourced from outside the state and not for sale, the High Court's dismissal of the writ petition challenging the market fee was erroneous. Consequently, the Court set aside the High Court's decision, affirming that the market fee was not applicable in this case under Article 226 of the Constitution of India.
