Judgment text excerpt

The Supreme Court held that the filing of the award by the advocate of the arbitrator on 23.3.1996 constituted deemed notice under Section 14(2) of the Arbitration Act, 1940, thereby commencing the limitation period for setting aside the award. The Court clarified that the limitation period begins from the date the notice of filing is received by the parties, which in this case was on 14.6.1996. Consequently, the appeal was allowed, and the earlier decision of the High Court was set aside, allowing ONGC's application to set aside the award.
