Judgment text excerpt
The Supreme Court held that the appointment of a Principal to a Law College must comply with the qualifications mandated by the Advocates Act, 1961, and the Bar Council of India Rules. The Court found that the High Court's reliance on the Uttar Pradesh State Universities Act, 1973, which it deemed to conflict with the Advocates Act, was incorrect. The Court emphasized that the Bar Council of India has the authority to regulate legal education and that any appointment not adhering to the qualifications set forth in the Advocates Act is void. Consequently, the Court set aside the High Court's judgment and upheld the Bar Council's position regarding the qualifications required for the appointment of a Principal of a Law College.
