The Supreme Court set aside the order of the Madhya Pradesh High Court which dismissed the review petition filed by the appellant under the Madhya Pradesh Entertainment Duties (Advertisement Tax) Act, 1936. The Court held that the appellant was left without a remedy as the Division Bench had indicated that the grievance could be addressed in a review petition, yet the Single Judge deemed it not maintainable. The Court directed that the Letters Patent Appeal be heard and disposed of on merits in accordance with law.
