The Supreme Court upheld the orders of the Gujarat High Court directing the release of 78 gold bars seized by the Commissioner of Customs under Section 111(d) and Section 112(a) of the Customs Act. The Court found that the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) had correctly determined that the 8 bars of gold did not bear any foreign mark and lacked evidence of illegal importation. Consequently, the Court dismissed the special leave petitions filed by the Commissioner of Customs, affirming the High Court's decision to release all seized gold bars.
