The Supreme Court held that the appointments made by the Respondents in the Marketing Division of the Appellant, a public sector undertaking, were invalid as they contravened the Employment Exchange (Compulsory Notification of Vacancies) Act, 1959, and the Appellant's own Recruitment and Promotion Rules. The Court emphasized that recruitment on a contractual basis does not entitle an individual to claim regularization in service. Consequently, the Court upheld the Appellant's policy decision to restrict recruitment and ruled that the Respondents were not entitled to regular employment.
