The Supreme Court set aside the High Court's judgment which had annulled the proceedings of a Summary Court Martial on the grounds of non-observance of Army Rule 180. The Court found that the inquiry had indeed complied with the said rule, thus affirming the punishments of rigorous imprisonment and dismissal from service imposed on the respondents. The Court held that the seriousness of the charges justified the punishments, which were not disproportionate or excessive.
