The Supreme Court held that the State of Maharashtra's policy decision not to grant 'No Objection Certificate' (NOC) for new B.Ed. colleges was not binding on the National Council for Teacher Education (NCTE) under the National Council for Teacher Education Act, 1993. The Court emphasized that NCTE's authority to grant permission supersedes state policy when it comes to educational institutions. Consequently, the Court upheld the High Court's decision to allow the petitioner's application for establishing a B.Ed. college, thereby setting aside the State's order dated December 28, 2004.
