Judgment text excerpt

The Supreme Court held that the recommendations made by the Uttar Pradesh Public Service Commission (UPPSC) for appointments were not binding on the newly formed State of Uttaranchal, as per Articles 320 and 323(2) of the Constitution and Section 178 of the U.P. Reorganisation Act, 2000. The Court found that the Uttaranchal Government's order denying acceptance of UPPSC recommendations was valid, and the High Court's interpretation was incorrect. Consequently, the appeal by the State of Uttaranchal was allowed, overturning the High Court's directive for appointments.
