Judgment text excerpt

The Supreme Court examined whether the 'Mana' community in Maharashtra qualifies as a Sub-Tribe of 'Gond' and thus as a Scheduled Tribe under Article 342 of the Constitution of India. The Court held that the classification of tribes is determined by the President's notification under Article 342, and the Mana community is included within the Gond classification as per the Scheduled Castes and Scheduled Tribes (Amendment) Act, 63 of 1956. The Court also clarified that the previous decisions in Dina I and Dina II are not overruled by the Constitution Bench in State of Maharashtra v. Milind Katware, thus maintaining the legal status of the Mana community as a Scheduled Tribe.
