The Supreme Court held that under Section 139(1)(f) of the Bihar Panchayat Raj Act, 1993, a person dismissed from service for misconduct is disqualified from holding a position in the Panchayat. The Court found that the State Election Commission had the authority under Rule 122 to determine disqualifications and that the appellant's dismissal was a valid ground for disqualification. Consequently, the Court set aside the Patna High Court's order allowing the writ petition and upheld the decision of the State Election Commission regarding the appellant's disqualification.
