The Supreme Court held that the recommendations made by the Uttar Pradesh Public Service Commission (UPPSC) are not binding on the newly formed State of Uttaranchal, as per the interpretation of Articles 320 and 323(2) of the Constitution and Section 178 of the U.P. Reorganisation Act, 2000. The Court found that the Uttaranchal Government's order denying appointments based on UPPSC recommendations was valid and upheld the High Court's decision as incorrect. Consequently, the appeal by the State of Uttaranchal was allowed, and the High Court's judgment was set aside.
