The Supreme Court held that the Uttar Pradesh Industrial Peace (Timely Payment of Wages) Act, 1978 mandates timely wage payments to employees, and the authority's jurisdiction to issue a recovery certificate is based on the amount due at the time of claim initiation. The Court found that the High Court erred in quashing the Deputy Labour Commissioner's order, as the claim amount exceeded Rs.50,000 at the time of filing. Consequently, the appeal was allowed, reinstating the recovery order against the employer.
