Judgment text excerpt

The Supreme Court quashed the detention order under Section 3(1) of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act, 1982, holding that there was insufficient material to establish that the detenu was habitually committing offences as required by Section 2(f) of the Act. The Court found that the grounds of detention were inadequate and did not substantiate the claim of habitual criminality, leading to the conclusion that the detention was unjustified. Consequently, the appeal was allowed, and the High Court's dismissal of the Habeas Corpus petition was overturned.
