The Supreme Court held that the jurisdiction of civil courts is barred in matters concerning saunjidar rights under Section 11 of the Punjab Village Common Lands (Regulation) Act, 1961. The Court found that the High Court's dismissal of the Second Appeal without formulating a substantial question of law, as required by Section 100 of the Code of Civil Procedure, 1908, was permissible under the proviso to sub-section (5) of Section 100. Consequently, the appeal was allowed, and the judgments of the lower courts were set aside, dismissing the plaintiff's suit.
