The Supreme Court held that the provisions of Section 25F of the Industrial Disputes Act, 1947 are not applicable as the respondent-workman did not work for 240 days in a calendar year, having only worked for 227 days over four years. The Court found that the Labour Court's conclusion was factually incorrect and that the respondent failed to provide sufficient evidence to support his claim. Consequently, the Court set aside the order of reinstatement and back wages issued by the lower courts, allowing the appeal.
