The Supreme Court held that under Section 166 of the Motor Vehicles Act, 1988, the liability for compensation in a motor accident case must be shared as directed by the Tribunal. The Court found that the Calcutta High Court erred in directing the appellant Corporation to pay the entire compensation amount when the Superintendent of Police, who was also liable, did not appeal the Tribunal's decision. The Court reinstated the Tribunal's order that both parties were to pay the compensation in equal shares, thus upholding the principle of shared liability in motor accident claims.
