The Supreme Court remitted the matter back to the Allahabad High Court for detailed investigation regarding the calculation of post-retiral benefits for the respondent, a Hindi Lecturer, by considering Section 33 of the Uttar Pradesh State Universities Act, 1973, and Regulation 15.05 of the University Statute. The Court set aside the High Court's order dated 31.3.2003, which had allowed the addition of services from Tinsukia Degree College to those at Mahatma Gandhi Kashi Vidyapith without sufficient reasoning. The Supreme Court directed the High Court to dispose of the writ petition within six months.
