Judgment text excerpt

The Supreme Court upheld the validity of Section 3 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, rejecting the appellants' claim that it violated Article 14 of the Constitution. The Court clarified that the Maharashtra Rent Control Act, 1999 does not override the provisions of the Public Premises Act, as the latter specifically addresses unauthorized occupants. The Court affirmed the dismissal of the writ petition by the Bombay High Court, thereby allowing the eviction proceedings to continue.
