Judgment text excerpt

The Supreme Court quashed the detention order under Section 3(1) of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act, 1982, holding that the detenu was not shown to be habitually committing crimes as required by Section 2(f) of the Act. The Court found that the grounds for detention lacked sufficient material evidence to justify the label of 'Goonda'. Consequently, the appeal was allowed, and the High Court's dismissal of the Habeas Corpus petition was overturned.
