The Supreme Court held that the provisions of Section 25F of the Industrial Disputes Act, 1947 are not applicable as the respondent-workman had only worked for 227 days over a period of four years, failing to meet the 240 days requirement under Section 25(B). The Court found that the Labour Court's conclusion regarding the workman's days of service was factually incorrect and that the initial appointment was void, thus invalidating the reinstatement order. Consequently, the appeal was allowed, setting aside the lower courts' orders for reinstatement and back wages.
