Judgment text excerpt

The Supreme Court held that the High Court's interference under Article 226 in the findings of the Labour Tribunal regarding the reinstatement of a daily wage employee was unjustified, as the employee did not establish a right to hold a regular post nor complete the requisite 240 days of service under Section 25F of the Industrial Disputes Act, 1947. The Court emphasized that the High Court cannot award relief on grounds not raised before the Tribunal and that the policy of the Reserve Bank of India should not be examined under Article 14 without a challenge of perversity. The appeal was allowed, setting aside the High Court's order for reinstatement with back wages.
