The Supreme Court held that the interim orders of the Orissa High Court restraining the Orissa Electricity Regulatory Commission from fixing tariffs for the periods 2002-03 and 2003-04 were indefensible, especially after the High Court had permitted the Commission to make such decisions. The Court found that the Commission had already fixed the tariffs and that any challenge to the tariffs could be made before the appropriate forum under the Orissa Electricity Reform Act, 1994. Consequently, the Court directed the High Court to treat the writ petitions as infructuous and quashed the contempt proceedings initiated by the High Court.
