The Supreme Court upheld the Tamil Nadu Administrative Tribunal's decision granting pension benefits to employees of the Transport Department under G.O.Ms. No.378 dated 18.4.1975 and G.O.Ms. No.378 dated 23.9.1985. The Court clarified that the denial of pension based on the argument that the respondents had not completed 10 years of qualifying service was incorrect, as their service should be counted from their initial entry into the Transport Department. The Court emphasized that the respondents were entitled to pension for their service rendered prior to their absorption into the Transport Corporations.
