Judgment text excerpt

The Supreme Court ruled that the respondent, a temporary Typist appointed by a Branch Manager of a statutory corporation, had a right to be regularized as a permanent employee under the M.P. Industrial Employment (Standing Orders) Rules, 1963. The Court held that the termination of his services was illegal as he was appointed against a vacant post and had been in continuous service, thus entitling him to regularization and back pay. The appeal by the corporation was dismissed, affirming the Labour Court's decision.
