The Supreme Court upheld the decision of the Bombay High Court affirming the Industrial Court's ruling that the appellant company committed unfair labor practices under the Maharashtra Recognition of Trade Unions & Prevention of Unfair Labour Practices Act, 1971. The Court found that the differential treatment of employees who accepted different Voluntary Retirement Schemes (VRS-I and VRS-II) constituted unfair labor practice as per items 5, 9, and 10 of Schedule IV of the Act. The Court confirmed the order for the appellant to pay Rs.90,000 to each employee who retired under VRS-I, similar to the benefits provided under VRS-II.
