Judgment text excerpt

The Supreme Court ruled that the respondent, a typist appointed temporarily by a Branch Manager, had a right to be regularized as a permanent employee under the M.P. Industrial Employment (Standing Orders) Rules, 1963 and the M.P. Industrial Employment (Standing Order) Act, 1961. The Court held that the termination of his services was illegal as he had been continuously employed under interim orders, thus establishing that an employee's right to regularization cannot be denied based on the manner of appointment. The appeal by the statutory corporation was dismissed, affirming the Labour Court's decision to regularize the respondent's employment.
