The Supreme Court held that employees who opted for the Voluntary Retirement Scheme (VRS) of Heavy Engineering Corporation Limited are entitled to the benefits of the revised scales of pay as per Circular No.5/97, issued on 9th October 1997, which had retrospective effect from 1st January 1992. The Court clarified that the exclusion clauses in the circular do not apply to employees who retired under the VRS, as they did not fall under the categories of dismissal or resignation without permission.
