The Supreme Court upheld the decision of the Bombay High Court affirming the Industrial Court's ruling that the appellant company committed unfair labor practices under the Maharashtra Recognition of Trade Unions & Prevention of Unfair Labour Practices Act, 1971. The Court found that the differential treatment of employees who accepted different Voluntary Retirement Schemes violated the assurance given to all employees regarding equal benefits. The Court held that the complaint was maintainable by individual employees and directed the company to pay Rs.90,000/- to those who accepted VRS-I, along with interest from the date of entitlement.
