Judgment text excerpt
The Supreme Court examined the legality of disqualification orders issued by the Speaker of the Haryana Legislative Assembly under the Tenth Schedule of the Constitution of India. The Court held that the principles of natural justice were violated as the disqualifications were made hastily to prevent the petitioners from voting in the Rajya Sabha elections. It was determined that the petitioners, being lone members of their respective parties, were entitled to protection under paragraph 3 of the Tenth Schedule due to the recognized split in their original parties, thus ruling the disqualifications invalid.
