Judgment text excerpt

The Supreme Court upheld the Madhya Pradesh High Court's decision to remand the case to the Appellate Authority for reconsideration of the quantum of punishment imposed on the respondent under the Central Civil Services (Classification, Control and Appeal) Rules, 1965. The Court found that the punishment of compulsory retirement was disproportionate to the alleged misconduct of non-disclosure of a second marriage in the attestation form. The Court emphasized that the delay in filing the complaint by the first wife should not automatically lead to severe disciplinary action against the respondent.
