Judgment text excerpt

The Supreme Court upheld the Kerala High Court's decision that the Corporation of Kochi's rejection of the Society's application for the renewal of its market license was unsustainable. The Court emphasized that the Society, registered under the Kerala Co-operative Societies Act, had a right to operate a private market under Section 2(31) of the Kerala Municipality Act, 1994, and that the delay in license renewal was due to oversight. The Court ruled that the Society should be allowed to continue its operations and pay the requisite fees, thereby reversing the Corporation's order.
