The Supreme Court upheld the decision of the Andhra Pradesh High Court affirming the Single Judge's ruling that the respondents, who retired before 1.7.1990, were discriminated against in the calculation of their pension and terminal benefits under the Andhra Pradesh State Electricity Reforms Act, 1998. The Court cited D.S. Nakara & Others v. Union of India (1983 (1) SCC 305) to establish that the cut-off date for pension benefits was discriminatory. The Court held that the respondents were entitled to the same benefits as those who retired after the cut-off date, thereby affirming their claim for arrears of pension and terminal benefits.
