Judgment text excerpt

The Supreme Court held that the Maharashtra State Electricity Board (MSEB) could not deny electricity connection to M/s. Amit Products (India) Ltd. based on the arrears owed by a previous consumer, M/s. Amar Amit Jalna Alloys Pvt. Ltd., as the appellant company is a distinct legal entity. The Court emphasized that the insistence on clearing the previous dues violated Article 14 and Article 19(1)(g) of the Constitution, which protect the right to equality and the right to carry on any profession, trade, or business. The Court overturned the High Court's decision, allowing the appellant's request for an electricity connection without the condition of settling the prior dues.
