Judgment text excerpt

The Supreme Court held that the termination of the respondent's services was illegal as it did not comply with the provisions of the Industrial Disputes Act, 1947, particularly regarding the requirement of continuous service of 240 days. The Court found that the Labour Court's conclusion that the respondent had completed the requisite days was not supported by reliable evidence, as the employer provided attendance records showing insufficient days worked. Consequently, the Court set aside the High Court's order and upheld the Labour Court's decision to reinstate the respondent with back wages from the date of termination.
