The Supreme Court upheld the decision of the Guwahati High Court affirming the Single Judge's order that the respondent, a casual worker at ONGC, had acquired the right to regularization after working for more than 240 days as per Section 25-F of the Industrial Disputes Act, 1947. The Court ruled that the respondent's termination was invalid as it did not comply with the statutory provisions, and the settlement reached with the unions did not apply to him since he was not a member. Consequently, the Court directed ONGC to absorb the respondent into a regular post, subject to eligibility criteria.
