Judgment text excerpt

The Supreme Court, under Section 11(6) of the Arbitration and Conciliation Act, 1996, addressed a petition for the appointment of an arbitrator concerning a dispute between a Singaporean company and the Russian public sector company ROSOBORONEXPORT. The Court recognized the contractual relationship established through a Memorandum of Understanding and subsequent agency agreement for the supply of helicopters to the Border Security Force. The Court held that the arbitration clause in the agreement necessitated the appointment of an arbitrator to resolve the disputes arising from the contractual obligations.
