The Supreme Court held that under Section 19 of the Prevention of Corruption Act, 1988, prior sanction is necessary for prosecuting public servants under Section 13(2) of the Act. The Court found that the High Court's order summoning the appellant without such sanction was erroneous, leading to the conclusion that the appellant could not be prosecuted. Consequently, the Supreme Court set aside the High Court's order and quashed the summons issued against the appellant.
