Judgment text excerpt

The Supreme Court held that the High Court's judgment in a second appeal under Section 100 of the Code of Civil Procedure, 1908, cannot be maintained as it failed to formulate a substantial question of law before reversing the findings of fact of the lower courts. The Court reiterated that the jurisdiction of the High Court is limited to appeals involving substantial questions of law, as established in Ishwar Dass Jain v. Sohan Lal and Roop Singh v. Ram Singh. Consequently, the appeal was allowed, and the High Court's decision was set aside.
