The Supreme Court upheld the decision of the Guwahati High Court, affirming that the respondent, a casual worker at ONGC, had a right to be absorbed into a regular post after working for more than 240 days as per Section 25-F of the Industrial Disputes Act, 1947. The Court ruled that the respondent's termination without following due process was unlawful and that the settlement reached with the union did not apply to him as he was not a member. Consequently, the Court directed ONGC to regularize the respondent's employment, subject to eligibility criteria.
