Judgment text excerpt

The Supreme Court held that under the Bihar Buildings (Lease, Rent and Eviction) Control Act, the landlord is entitled to evict a tenant if the tenant sub-lets the premises without consent, as per Section 11(1)(b). The Court found that A.N. Singh had indeed sub-let the premises to the District Congress Committee and had defaulted on rent payments, thus justifying the eviction. The Court upheld the trial court's decision and dismissed the appeal, affirming the eviction order.
