Judgment text excerpt

The Supreme Court addressed the validity of the West Bengal State Electricity Board's requirement for a Rs.30 lakh earnest money deposit from bidders, which was challenged as discriminatory against private entities under the Electricity Act, 2003. The Court held that the exemption granted to Central/State Government Organizations and PSUs was arbitrary and violated principles of equality, thus ruling the condition unconstitutional. The interim order of the Calcutta High Court was set aside, allowing the writ petition to proceed without the contested earnest money requirement.
