Judgment text excerpt

The Supreme Court upheld the dismissal of petitions under Section 482 of the Criminal Procedure Code, affirming the Madras High Court's decision that the allegations under Sections 498-A and 406 IPC and Sections 3 and 4 of the Dowry Prohibition Act required a full trial for proper appreciation. The Court found that the contentions regarding lack of territorial jurisdiction and limitation under Section 468(1) Cr.P.C. were not sufficient to quash the proceedings at this stage. The Court held that the trial court is the appropriate forum to evaluate the merits of the allegations, thereby maintaining the status quo of the proceedings in C.C. No. 72/2002.
